Help Housing assists homeowners facing foreclosure with the preparation of documents in order to challenge the validity of a foreclosure. Mortgage Lenders and Trustees are required by law to follow the legal procedures to foreclose on an owner’s property. Once the Trustee is challenged with a compliance violation, they must postpone the sale date in order to have sufficient time to verify the challenge or be held liable.
We prepare documents based on your client’s situation and submit a comprehensive list of compliance violations to the Trustee. Its purpose is to challenge the legitimacy of the foreclosure and forces the Trustee to provide the documentation required to prove they are in compliance with State, Federal, and Foreclosure Civil codes or the Trustee will be liable for a wrongful foreclosure. Therefore, the Trustee will postpone the foreclosure sale date on the property, while they research the compliance, complaint and prove the legitimacy of the foreclosure proceedings.
Once we have confirmed the foreclosure postponement, our clients either move forward and complete their loan modification or short sale with this additional time the we have provided to them.

In the LOSS MITIGATION process the first step is the Feasibility Phase:
Basically this is to determine what programs are available based on your housing, financial and lender/servicing situation. So I put together a mini-application package to help me determine how any client might apply or be accepted into any one of the various programs. The mini –application package allows me to do 3 things on your behalf.
1. Gives a basic idea of what your overall goals and qualifications are to either keep or sell your property.
2. Give me authorization to contact your lender /servicer to see what programs they have available; or determine any progress you have made in a program you have applied.
3. Finally it allows me to actually help put a plan in place for you as to how you might be able to move forward.
Once I receive these documents back it usually takes about a week for me to contact your current lender and analyze your specific situation. I have access to some very good non-profit programs that may be actually able to help.

*HOW DO I GET PAID? Ultimately if we short sale your house we will get paid by the lender. Any of the other programs we may help you with we would not be paid on and it is actually a free service. We do this in the hopes that you may refer other possible clients our way. I have personally been involved in “LOSS MITIGATION” negotiation for about three years.

HAFA have developed a Short Sale Buy Back Program. Here are the salient points:

The Non Profit Organization we work with makes a short sale offer on the home. The offer is for all cash.

The Non Profit will handle all the processing and negotiation of the short sale for the listing agent. This allows the listing agent to go out and find more listings.

When the short sale is approved, the Non Profit buys the property.

The former owners then lease the property with option to buy. The Nonprofit Organization will hold the property for up to three years. That should be enough time for the family, with help, to repair their credit so that they can qualify for a new mortgage.

You can buy back the house at any point in those three years.
