Help Housing assists homeowners facing foreclosure with the preparation of documents in order to challenge the validity of a foreclosure. Mortgage Lenders and Trustees are required by law to follow the legal procedures to foreclose on an owner’s property. Once the Trustee is challenged with a compliance violation, they must postpone the sale date in order to have sufficient time to verify the challenge or be held liable.
We prepare documents based on your client’s situation and submit a comprehensive list of compliance violations to the Trustee. Its purpose is to challenge the legitimacy of the foreclosure and forces the Trustee to provide the documentation required to prove they are in compliance with State, Federal, and Foreclosure Civil codes or the Trustee will be liable for a wrongful foreclosure. Therefore, the Trustee will postpone the foreclosure sale date on the property, while they research the compliance, complaint and prove the legitimacy of the foreclosure proceedings.
Once we have confirmed the foreclosure postponement, our clients either move forward and complete their loan modification or short sale with this additional time the we have provided to them.
